Responding to foreign countervailing investigations will be a new challenge for Chinese companies.

According to the China Business Journal, the report said that from January to July this year, 149 members of the World Trade Organization filed 87 anti-dumping lawsuits, which was significantly lower than the 105 cases in the same period last year. However, the anti-dumping lawsuit against China has increased from 23 last year to 32.

In addition to China, the other two countries and regions that have suffered the most anti-dumping lawsuits are the United States and Taiwan, which suffered six anti-dumping lawsuits in the first half of this year.

At present, 36 countries around the world have successively recognized China's full market economy status. As China's market economy status is recognized by more countries, cases of countervailing investigations in other countries will gradually increase.

Since the first anti-subsidy investigation initiated by Canada on China's barbecues in 2006, it has launched countervailing investigations on composite wood flooring and steel fasteners. At the same time, the United States and the European Union have begun investigating the application of domestic laws against countervailing investigations against “non-market economy” countries. Earlier, the US House of Representatives passed the US Trade Rights Enforcement Act, which aims to impose countervailing duties on Chinese goods.

China has taken measures in recent years to cancel many subsidy policies. At present, the EU implements the most subsidy policy. According to statistics, the EU's subsidies for export enterprises account for more than 90% of the world's export subsidies.

Dealing with foreign countervailing investigations will be a new challenge for Chinese companies and governments. Governments at all levels in China should thoroughly study the international rules of countervailing investigations, grasp the countermeasures, speed up the clean-up and formulation of relevant regulations and policies, and make them consistent with WTO rules. Enterprises and lawyers should also actively explore and accumulate anti-subsidy response experience, and jointly resolve the adverse effects of foreign countervailing investigations on Chinese products.
